Welcome to the CalStrat Law Group website ("we," "our," or "us"). By accessing or using our website at calstratlaw.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully.

These Terms govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site. If you do not agree to these Terms, you must not access or use the Site.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE. By using the Site or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Site.

2. Website Management and Ownership

IMPORTANT: This website and all digital content are managed, operated, and owned by MacCap, LLC, a subsidiary of Drodler, Corp. MacCap, LLC is a digital development agency and is NOT a law firm. CalStrat Law Group has authorized MacCap to develop and host this website and create digital content on its behalf, but has not necessarily authorized or agreed to any specific content or material displayed herein.

MacCap, LLC is the responsible party and data holder for all information collected through this website. As the website operator, MacCap, LLC implements various technologies including analytics tracking, biometric identity verification, geo-tagging, and facial recognition for site optimization and security purposes.

Any communications made through this website are with MacCap, LLC, not directly with CalStrat Law Group. MacCap, LLC will forward relevant information to CalStrat Law Group at its discretion.

This website is intended for users who are at least 18 years old. By using this website, you represent and warrant that you are of legal age to form a binding contract with MacCap, LLC and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

3. No Attorney-Client Relationship

PLEASE READ CAREFULLY: The information provided on this Site is for general informational purposes only and does not constitute legal advice. No attorney-client relationship is formed by visiting this Site, submitting information through it, or communicating with anyone through this Site. An attorney-client relationship is only established after:

  1. You have had direct communication with an attorney at CalStrat Law Group;
  2. The attorney has evaluated your specific legal matter;
  3. Both you and the attorney have agreed to establish an attorney-client relationship; and
  4. You have signed a formal engagement letter with CalStrat Law Group.

Communications with anyone through this Site or via email do not establish an attorney-client relationship. Do not send any confidential information until you have spoken with one of our attorneys and received explicit authorization to send such information.

No attorney-client privilege: Until an attorney-client relationship is formally established as described above, no communications are protected by attorney-client privilege. This means that information you provide through this website may not be confidential or protected from disclosure.

No legal advice: The content on this Site is provided for informational purposes only and is not intended to be a substitute for professional legal advice, diagnosis, or treatment. 4. Case Evaluation

The case evaluation form on our Site is designed to collect basic information about your potential legal matter. By submitting this form, you grant MacCap, LLC permission to use the information you provide to evaluate your potential legal claim and determine whether to forward your information to CalStrat Law Group.

Important: Submitting a case evaluation form does NOT establish an attorney-client relationship. CalStrat Law Group is under no obligation to contact you or represent you based on information submitted through the case evaluation form.

While we take reasonable measures to protect your information, no technology is completely secure, and you should not share sensitive personal information like social security numbers, financial account details, or medical record numbers through our Site.

Statute of limitations: Legal claims are subject to time limitations known as statutes of limitations. These time limits vary by jurisdiction and type of claim. Submitting a case evaluation form does not toll (pause) any applicable statute of limitations. If you believe you have a legal claim, you should promptly consult with an attorney to ensure your rights are protected.

No attorney-client relationship: Submitting a case evaluation form does not create an attorney-client relationship with CalStrat Law Group or any of its attorneys. CalStrat Law Group reserves the right to decline representation for any reason, including but not limited to conflicts of interest, cases outside our practice areas, or cases that do not meet our acceptance criteria.

5. AI Legal Assistant

Our Site may offer an AI Legal Assistant feature. This feature is designed to help you provide comprehensive information about your case, but it is not a substitute for legal advice from a licensed attorney.

Important: The AI Legal Assistant is operated by MacCap, LLC, not by CalStrat Law Group. Your interactions with the AI Legal Assistant will be processed using artificial intelligence technology. Information you provide will be stored by MacCap, LLC and may be forwarded to attorneys and staff at CalStrat Law Group at MacCap's discretion.

The AI may occasionally provide inaccurate or incomplete information. All information provided by the AI should be verified by a licensed attorney. MacCap, LLC and CalStrat Law Group disclaim all liability for any information provided by the AI Legal Assistant.

No legal advice: The AI Legal Assistant does not provide legal advice. It is a tool designed to collect information and provide general information only. Any information provided by the AI Legal Assistant should not be relied upon as legal advice or as a substitute for consultation with a qualified attorney.

Limitations: The AI Legal Assistant has inherent limitations, including but not limited to:

  • It may not have access to the most current legal information or precedents
  • It cannot assess the credibility of information provided to it
  • It cannot make judgment calls that require human discretion
  • It may misinterpret complex legal questions or factual scenarios
  • It may generate responses that appear authoritative but are incorrect or incomplete

Data processing: Your interactions with the AI Legal Assistant may be recorded, stored, and used to improve the AI system. By using the AI Legal Assistant, you consent to such recording, storage, and use of your interactions.

6. Communications and Consent

By providing your contact information through our Site, you are providing that information to MacCap, LLC, not directly to CalStrat Law Group. If you opt in to receive communications, you are consenting to receive communications from both MacCap, LLC and CalStrat Law Group.

These communications may include:

  • Phone calls (including to mobile devices)
  • Text messages (SMS and MMS)
  • Emails
  • Automated messages and notifications
  • Pre-recorded messages

Consent is not required: You are not required to provide consent to receive communications in order to receive legal services. You may revoke your consent at any time by contacting us at the information provided below.

Standard rates apply: Message and data rates may apply to any communications sent to your mobile device. You are solely responsible for any fees charged by your mobile carrier.

Telephone Consumer Protection Act (TCPA) notice: By providing your telephone number and checking the consent box, you expressly authorize MacCap, LLC and CalStrat Law Group to contact you by telephone (including through automated dialing systems, prerecorded messages, and/or artificial voice messages) at the number provided, even if that number is on a state or federal Do Not Call registry. This consent is not required as a condition of purchasing any goods or services.

Recording of communications: Telephone calls and other communications with MacCap, LLC or CalStrat Law Group may be recorded or monitored for quality assurance, training, and record-keeping purposes. By communicating with us, you consent to such recording and monitoring.

7. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by MacCap, LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
  • If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

Trademarks: The CalStrat Law Group name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CalStrat Law Group or its affiliates or licensors. You must not use such marks without the prior written permission of CalStrat Law Group. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

Prohibited uses: You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To impersonate or attempt to impersonate MacCap, LLC, CalStrat Law Group, a CalStrat Law Group employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which may harm MacCap, LLC, CalStrat Law Group, or users of the Site
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site
  • To attack the Site via a denial-of-service attack or a distributed denial-of-service attack
  • To otherwise attempt to interfere with the proper working of the Site

MacCap, LLC collects and processes various types of data through this website, including but not limited to:

  • Personal information you voluntarily provide
  • Usage data and analytics
  • Location data and IP addresses
  • Device information
  • Cookies and tracking technologies

9. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER MACCAP, LLC, CALSTRAT LAW GROUP, NOR ANY PERSON ASSOCIATED WITH THEM MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

WITHOUT LIMITING THE FOREGOING, NEITHER MACCAP, LLC, CALSTRAT LAW GROUP, NOR ANYONE ASSOCIATED WITH THEM REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, MACCAP, LLC AND CALSTRAT LAW GROUP HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

10. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL MACCAP, LLC, CALSTRAT LAW GROUP, THEIR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

IN NO EVENT SHALL THE COLLECTIVE LIABILITY OF MACCAP, LLC, CALSTRAT LAW GROUP, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID TO MACCAP, LLC OR CALSTRAT LAW GROUP FOR THE APPLICABLE SERVICE OUT OF WHICH LIABILITY AROSE.

THE LIMITATIONS OF LIABILITY SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN MACCAP, LLC, CALSTRAT LAW GROUP, AND YOU. THE LIMITATIONS WILL APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless MacCap, LLC, CalStrat Law Group, their affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms.

This indemnification obligation includes, but is not limited to, claims arising out of or related to:

  • Your use of the Site or any information obtained from the Site
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
  • Your violation of any law, rule, or regulation
  • Any claim that your content caused damage to a third party
  • Any misrepresentation made by you
  • Any unauthorized access to or use of our servers or any personal information or user data stored therein

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of MacCap, LLC or CalStrat Law Group, as applicable.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in San Diego County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the state and federal courts located in San Diego County, California, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action, or proceeding arising out of these Terms.

13. Arbitration

PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

At our sole discretion, we may require you to submit any disputes arising from these Terms or use of the Site, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.

BY AGREEING TO THESE TERMS, YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO A TRIAL BY JURY IN ANY DISPUTE, ACTION OR PROCEEDING.

Agreement to Arbitrate: You and MacCap, LLC agree that all disputes, claims, or controversies arising out of or relating to these Terms or the Site that are not resolved by mutual agreement shall be resolved through final and binding arbitration as set forth in this section. This agreement to arbitrate is intended to be broadly interpreted and includes, without limitation:

  • Claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory
  • Claims that arose before this or any prior agreement (including, but not limited to, claims relating to advertising)
  • Claims that are currently the subject of purported class action litigation in which you are not a member of a certified class
  • Claims that may arise after the termination of these Terms

Arbitration Procedures: The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the "AAA Rules") then in effect. The arbitration shall be conducted by a single neutral arbitrator selected in accordance with the AAA Rules. The arbitrator shall be a retired judge or attorney with at least 15 years of experience in the substantive laws applicable to the subject matter of the dispute. The arbitration shall take place in San Diego County, California, unless you and MacCap, LLC agree otherwise.

Arbitrator's Powers: The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability, or formation of these Terms, including but not limited to any claim that all or any part of these Terms is void or voidable. The arbitrator shall be empowered to grant whatever relief would be available in a court under law or in equity. The arbitrator's award shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction.

Costs of Arbitration: Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules. If the arbitrator finds that either the substance of your claim or the relief sought is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules.

Confidentiality: All aspects of the arbitration proceeding, including but not limited to the award of the arbitrator and compliance therewith, shall be strictly confidential. The parties agree to maintain confidentiality unless otherwise required by law. This paragraph shall not prevent a party from submitting to a court of law any information necessary to enforce this arbitration provision, to enforce an arbitration award, or to seek injunctive or equitable relief.

Severability: If any part or parts of this Arbitration Agreement are found under the law to be invalid or unenforceable, then such specific part or parts shall be of no force and effect and shall be severed, and the remainder of the Arbitration Agreement shall continue in full force and effect.

Survival of Agreement: This Arbitration Agreement will survive the termination of your relationship with MacCap, LLC.

Small Claims Court: Notwithstanding the foregoing, you may bring an individual action in the small claims court of your state or municipality if the action is within that court's jurisdiction and is pending only in that court.

Right to Opt Out: You have the right to opt out of this agreement to arbitrate by sending written notice of your decision to opt out to: legal@maccap.com within 30 days of first accepting these Terms. If you opt out of this arbitration agreement, MacCap, LLC also will not be bound by it.

14. Class Action Waiver

ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL ACTION.

You and MacCap, LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and MacCap, LLC agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. If you choose to pursue your dispute in court by opting out of the arbitration provision as specified above, this class action waiver will not apply to you. Neither you, nor any other customer, can be a class representative, class member, or otherwise participate in a class, consolidated, or representative proceeding without having complied with the opt-out procedure set forth above.

15. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

You are expected to check this page frequently so you are aware of any changes, as they are binding on you. If we make material changes to these Terms, we may notify you either through the email address you have provided us or by placing a prominent notice on our Site.

16. California Compliance

This website complies with California Business and Professions Code § 6157 et seq. regarding attorney advertising. The content of this website has not been approved by the State Bar of California. This website is designed to provide general information only and should not be relied upon as legal advice.

In accordance with California Rules of Professional Conduct, we inform you that this website is a form of communication that may be considered attorney advertising.

17. Digital Millennium Copyright Act (DMCA) Notice

If you believe that content available on or through the Site infringes one or more of your copyrights, please immediately notify our DMCA agent by providing a written notice ("Infringement Notice") containing the information described below to the designated agent listed below. If MacCap, LLC takes action in response to an Infringement Notice, it will make a good faith attempt to contact the party that made such content available by means of the most recent email address, if any, provided by such party to MacCap, LLC.

Your Infringement Notice must include:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit MacCap, LLC to locate the material
  • Information reasonably sufficient to permit MacCap, LLC to contact you, such as an address, telephone number, and, if available, an email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

18. Force Majeure

Neither MacCap, LLC nor CalStrat Law Group shall be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in fulfilling or performing any term of these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of MacCap, LLC or CalStrat Law Group including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lockouts, strikes or other labor disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

19. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

20. Entire Agreement
